SALES PROVISION- SELLER NOT MERCHANT OF PRODUCT
The goods to be sold under this agreement represent a new line of merchandise that has not previously been sold by seller, and as to the sale of goods subject to this agreement seller shall not be deemed a merchant, but shall be deemed a non-merchant as that term is defined or may be construed under the Uniform Commercial Code of [State of Code] in effect on the date of execution of this agreement.
This is a UCC-buying and selling form.
It is intended to be an addendum to other forms.
